1. INTRODUCTION

In order for us to provide you with our games and related services which include gaming applications for mobile computing devices, social media gaming applications, fan pages, contests, promotions, forums, websites, viral features and related technology, and certain other services we provide ("Services"), it is important that we incorporate certain legal guidelines and rules to make sure everyone's rights are respected and that we are doing what we can to protect users' rights and your personal privacy.

Please read this Terms of Use Agreement (the "Terms") carefully, as it constitute a legally binding agreement and applies to your use of the Services provided by Time Plus Q Technologies OU, an Estonian private limited company having a business address of J. Vilmsi tn 11-6, 10126 Tallinn, Estonia.

2. ELIGIBILITY

By using the Services, you represent, warrant and covenant that:

• Your use of the Services does not violate any applicable law, rule or regulation
• All registration information you submit is truthful and accurate

If you provide information that is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your registration and refuse any current or future use of the Services.

3. MODIFICATIONS

We may modify these Terms from time to time, at any time, without notice to you, for any reason, in our sole discretion. Each modification shall be effective upon posting of the updated Terms. We recommend that you check back frequently and review these Terms regularly.

4. LIMITED LICENSE

Subject to your agreement and continuing compliance with these Terms, Time Plus Q grants you a non-exclusive, non-transferable, revocable limited license to access and use the Services using a supported web browser or mobile device solely for your own non-commercial entertainment purposes.

5. VIRTUAL CURRENCY

You understand that while you may "earn," "buy," or "purchase" virtual currency or virtual in-game items, these real world terms are only being used as shorthand. You do not actually "own" these Virtual Items - rather, you purchase a limited license to use the Services.

6. LICENSE LIMITATIONS

ANY USE OF THE SERVICES IN VIOLATION OF THESE LIMITATIONS IS STRICTLY PROHIBITED and may result in immediate revocation of your license and subject you to liability.

7. PROPRIETARY RIGHTS

Time Plus Q owns, solely and exclusively, all right, title and interest in and to the Services and all content contained therein. This includes all games, artwork, graphics, logos, text, themes, objects, characters, audio-visual effects, methods of operation, documentation, and computer code.

You acknowledge and agree that you have no ownership or property interest in any account, and all rights in and to accounts are owned by Time Plus Q.

8. USER CONTENT

By submitting any User Content while using the Services, you grant Time Plus Q a perpetual, irrevocable, worldwide, fully paid-up and royalty-free, non-exclusive license to use, reproduce, modify, create derivative works from, and distribute your User Content in connection with our Services.

9. PERSONAL INFORMATION

We respect your privacy and the protection of your personally identifiable information. Our information collection and use policies are set forth in our Privacy Policy, which is incorporated into these Terms by reference.

10. ACCOUNT AND PASSWORD

If you create an account, you are responsible for maintaining the strict confidentiality of your User ID and password. You are responsible for any access to or use of the Services using your User ID, whether authorized or not.

To deactivate your account, please contact us. Remember that complete deactivation will result in the loss of all gaming achievements and unused virtual items, which cannot be restored.

11. PURCHASES AND ORDERS

Purchases of virtual items are non-refundable. When you purchase virtual items, your order represents an offer to purchase a license for the relevant Services, which is accepted when we make the items available in your account.

You agree to pay all fees and applicable taxes. We may revise pricing at any time. We are not required to provide refunds for any reason, and you will not receive compensation for unused virtual items when an account is closed.

12. THIRD-PARTY INTERACTIONS

The Services may include advertisements, hyperlinks to third-party websites, or integration with third-party social networks. We are not responsible for any third-party content, websites, or services, and encourage you to read their terms and privacy policies.

13. COPYRIGHT PROTECTION

We respect intellectual property rights. If you believe that content on our Services infringes your copyrights, please contact our Copyright Agent with a DMCA notice:

You agree to defend, indemnify and hold Time Plus Q harmless from any claims, damages, losses, costs and expenses arising from your use of the Services, your breach of these Terms, or your User Postings.

These Terms are governed by the internal substantive laws of the State of California. You agree to submit to the exclusive jurisdiction of the State and Federal Courts situated in California and County of San Francisco.
